  • Tell your state legislators: Stand with us, not with ALEC!

    The corporate-funded American Legislative Exchange Council (ALEC) has been getting a lot of attention lately -- most recently for their role in advancing irresponsible so-called "Stand Your Ground" legislation that has been cited in the Trayvon Martin tragedy in Florida. ALEC has been pushing policies for the last four decades that have damaged state economies, heightened income inequality, and attacked immigrants, women, and workers.

    Thanks to the voices of constituents like you, ALEC, their corporate backers, and their legislator members are in retreat.

    A dozen corporations have pulled support from the controversial group after learning more about their true mission, and ALEC recently announced the elimination of a corporate-legislator "task force" that was reported to have been responsible for Arizona's anti-immigrant SB0170, voter suppression efforts, and "Stand your Ground" laws.

    Now, a growing group of state lawmakers from across the nation is taking a stand against ALEC and showing the nation that there is a different approach -- one that advances responsible solutions that truly focus on the economic security of families, not corporate profits and heinous laws like "Stand your Ground."

  • Open Letter: We Stand With Our Constituents Against ALEC

    Text of letter:

    As state legislators from across the nation, we have heard from many constituents in recent days and weeks about their strong opposition to the policies of the American Legislative Exchange Council (ALEC). They have shared legitimate concerns about the roles of legislators in this controversial organization that promotes a corporate agenda which corrupts our democracy by suppressing voter participation, bankrupting states, and promoting unconscionable policies such as “Stand Your Ground” laws.

    Let us assure you—we are not members of ALEC.

    The legislation ALEC has supported over the years has helped starve state economies of jobs, increased historic levels of income inequality and inflamed political passions, while preventing responsible lawmakers from focusing on real solutions in their states.

    But we are happy to inform you that there is an alternative. Over the past seven years a growing national community of responsible state legislators has been fighting back against ALEC’s approach by focusing on real solutions for our states and our constituents.

    As attention finally turns to the destructive role played by ALEC in our states, we are proud to be standing with this national community of state lawmakers – a group that has worked over the years to advance health reform and its effective implementation, to change the debate over the Iraq war, and to turn the tide on the wave of destructive attacks on immigrants, workers, women, and voters that overtook statehouses following the elections of 2010.

    We stand with our constituents in opposition to ALEC’s destructive corporate-backed polices, and we look forward to continuing to work with all interested in advancing responsible solutions that truly advance the economic security of each of our states and all our families.

    Support Contraceptive Coverage for All Women: Sign the State Legislator Letter to HHS

    The recent blowback against the Obama administration's efforts to guarantee access to basic health care like contraceptives threatens to endanger the health of women across the nation.

  • Sign the Open Letter to Secretary of Labor Hilda Solis Urging DOL to Protect Home Care Workers

    The Fair Labor Standards Act (FLSA) has safeguarded federal minimum wage and overtime protections for workers since 1938, but more than 1.7 million home care workers who have been excluded from its reach are still vulnerable to egregious wage-and-hour violations.

    The Department of Labor (DOL) is currently considering a rule to revise the exemption so that home care workers - the majority of whom are women - can enjoy the same protections as other workers and, consequently, lift themselves out of poverty.  Lawmakers across the country are raising their voice to encourage the DOL to move forward with this long-overdue action.

  • Health Care Reform Litigation Retainer Agreement

    Conservative Attorneys General in multiple states have joined a multi-state lawsuit looking to overturn the reforms passed in the Patient Protection and Affordable Care Act.  While legal and constitutional scholars across the ideological spectrum agree that such efforts are frivolous and without constitutional merit, the right-wing has had some success in using the lawsuit, frivolous or not, as a messaging tool to advance the exaggerated notion that massive resistance to federal reform exists in the states.

    Because state legislators are actively involved in the implementation of the federal law and any delay will undermine their work, they have independent standing to join the proceedings.  Progressive States Network has recruited the Constitutional Accountability Center to act as counsel for legislators opposing these right-wing lawsuits.

  • Protect State Consumer Laws from Federal Preemption

    In the wake of the financial meltdown that engulfed the country last year largely caused by fraud and predatory lending, Congress is now debating the Consumer Financial Protection Agency Act (CFPA Act, H 3126).  The Act would create a Consumer Product Protection Agency for financial products similar to the Consumer Product Safety Board.

    Crucially, in the current proposed version of the legislation, the ability of states to also enforce their own tougher lending laws against national banks will be explicitly protected.  Keeping this provision in the bill is shaping up to be the big fight as the legislation moves through Congress.  As the CFPA Act goes to markup this month in the House Financial Services Committee, the major goal of banks and their legislative allies is stripping states of the power to enforce not only federal law, but also their own state lending laws.  Now the banks and their allies, which includes a large block of moderate Democrats on the House Financial Services Committee, want to block the robust state regulation that could have helped prevent the financial crisis from exploding in the first place. 

    Take action now to protect state consumer protection laws from federal preemption. 

    Use the form below to send a letter to your Members of Congress telling them to be sure that any federal financial reforms include strong provisions to strengthen state authority to protect consumers from financial industry abuses. 

    Without strong progressive support for states' rights in this area, we can expect any new national protections to come at the expense of what the states are already doing.

      Congressmembers must be educated about the regulatory failings that led to the current crisis, how states were hamstrung and couldn't step in to protect consumers, and how this scenario will repeat itself if the financial services industry gets its way.
